These Terms and Conditions ("Terms") govern your access to and use of Cabby's mobile applications, website at www.cabby.com.pk and related ride-hailing services (together, the "Services"), operated by Cabby ("Cabby", "we", "us" or "our"). By creating an account or using the Services, you agree to be bound by these Terms.

1. Acceptance of terms

By accessing or using the Services, you confirm that you have read, understood and agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Services. These Terms apply to riders, drivers and anyone else who uses the Services.

2. Eligibility and accounts

  • You must be at least 18 years old and able to form a legally binding contract to use the Services.
  • You agree to provide accurate, current and complete information when registering and to keep it up to date.
  • You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.
  • You must notify us immediately of any unauthorised use of your account.

3. The Services

Cabby is a technology platform that connects riders seeking transportation with independent drivers willing to provide it. Cabby does not itself provide transportation and is not a transportation carrier. The Services include ride booking, fare estimates, courier and intercity options, and related features. Availability may vary by area and time.

4. Fares and payments

  • Fare estimates shown in the app or on our website are indicative. The final fare is based on actual distance, time, ride type and applicable charges, tolls or taxes.
  • You agree to pay the fare for each completed trip using the payment method you select, whether cash or card.
  • Promotional prices, discounts and credits are subject to their own terms and may be changed or withdrawn at any time.
  • Where a payment fails, we may suspend your ability to book further rides until the balance is settled.

5. Cancellations and refunds

You may cancel a ride before or after a driver is matched, subject to our cancellation policy. A cancellation fee may apply if you cancel after a driver has been assigned or has arrived. Refunds, where applicable, are handled on a case-by-case basis through our support team.

6. User conduct

When using the Services, you agree not to:

  • Use the Services for any unlawful, fraudulent or harmful purpose.
  • Harass, threaten or endanger drivers, riders or any other person.
  • Damage vehicles or property, or carry prohibited or dangerous items.
  • Provide false information or impersonate another person.
  • Interfere with, disrupt or attempt to gain unauthorised access to the Services or their systems.

7. Drivers

Drivers using the Services are independent contractors, not employees of Cabby. Drivers are responsible for holding valid licences, registration and insurance, complying with all traffic and transport laws, and maintaining their vehicles in safe, roadworthy condition. Cabby verifies driver documents at onboarding but does not guarantee the conduct of any driver.

8. Disclaimers and liability

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Cabby is not liable for any indirect, incidental, special or consequential damages arising from your use of the Services, the conduct of any rider or driver, or any trip. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

9. Suspension and termination

We may suspend or terminate your access to the Services at any time, with or without notice, if you breach these Terms, create risk or possible legal exposure for us, or if required by law. You may stop using the Services and close your account at any time by contacting us.

10. Governing law

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute arising out of or in connection with the Services shall be subject to the exclusive jurisdiction of the courts of Lahore, Pakistan.

11. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you through the app or website. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
